By using BigTB.com (a.k.a. “BigTB” or “Our” “Company” website (“Site”) you agree to the terms and conditions in this agreement.

BigTB customers, new customers (“you” or “client”) are subject to these Terms and Conditions.

  1. Allowed Uses and Restrictions: Upon payment in full for services, BigTB grants client usage of website hosting services. The uses of these services may only be used for lawful activities as defined under United States law.
    You may use Our services for activities which include, but are not limited to the hosting of business websites, non-profit organizations, personal websites, or any digital content of a lawful and non-harmful nature.
    For purposes of defining a “harmful nature”, while that decisions remains at the sole discretion of BigTB, “harmful nature”, examples of “harmful nature” include, but are not limited to: threats of bodily harm or death to specific individuals, hosting content of violent events in such a way that it encourages more (i.e., dog fighting competitions, unlawful “street fight” competitions, etc), or organization of terrorist activities.
    Customers not abiding by our hosting policies are subject to the following:
    Forfeit of any payments made.
    BigTB may cooperate with any law enforcement seeking information which would assist in solving of any criminal activity alleged to have happened using BigTB services.
    If a customer is unsure if content meets BigTB policy, customers are welcome to submit their content for review and BigTB can provide them with a preliminary decision and any appropriate feedback.
  2. You may not use BigTB services in any way which is intended to cause harm to any other individual in a direct or indirect method. Examples of this include a prohibition on sending of spam, hacking efforts, or any other software manipulation generally considered to be disruptive to hardware and/or software.
  3. Liability Limitation and Warranty Information
    All services offered are with a good faith effort to provide maximum reliability for all customers. At times BigTB works with external vendors and providers and as such, BigTB is unable to guarantee 100% uptime. In no event shall BigTB be liable for damages exceeding a customers monthly payment amount.
  4. Right to Refuse Service
    Given the wide variety of customers which may seek BigTB services, it is impossible for BigTB to anticipate all of the situations under which BigTB would refuse a customer. BigTB reserves the right to refuse service to any customer who is abusive to BigTB or staff. BigTB further reserves the right to refuse service to any customer for “good cause” as determined by BigTB.
  5. Governing Law; Jurisdiction
    This Agreement shall be governed by and construed under the laws of the State of Nevada, without regard for the principles of conflicts of law of that State or any other state. Any litigation or other dispute relating to or arising under the Agreement shall only be brought in utmost good faith, having exhausted all reasonable efforts to reconcile, and only with the Duty to Limit Expenses associated with litigation.  
  6. Indemnification
    You agree to be responsible for any failure by any of your representatives to comply with the provisions of this agreement. You agree to indemnify the company and its representatives and save them fully harmless from and against any loss, cost, damage, expense or liability suffered or incurred by any of them arising as a result of or in connection with any failure by you or any of your representatives to comply with any provision of this agreement.
  7. Entire Agreement
    This agreement constitutes the entire agreement between the parties and supersedes any prior understanding or representation of any kind preceding the date of this agreement. Outside of the terms listed for billing purposes and selecting the product or service, there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this agreement. This agreement may be modified in writing and any such modifications must be signed by both you and BigTB.
